After a terrible crash left him seriously injured and one of his friends dead, Tracy Morgan has decided to sue Walmart for what he claims is its role in the accident.
Morgan suffered a broken leg, nose, and ribs when a Walmart truck collided with his limo bus last month on the New Jersey Turnpike. Several other passengers were also injured, and fellow comedian James McNair was killed.
Walmart employee Kevin Roper was driving 20 mph over the speed limit at the time of the accident, and was at the upper limit of his drive time, according to the National Transportation Safety Board. Last month, he pleaded not guilty to charges of vehicular homicide and assault by auto.
Morgan's attorneys filed the paperwork for the lawsuit on Thursday, accusing Walmart of negligence. They claim that the company should have known that Roper was awake for more than 24 hours before the June 7 crash and that he wasn't compliant with federal regulations. According to the suit, Roper drove over 700 miles from Georgia to Delaware on the day of the accident.
Meanwhile, Morgan and others injured in the crash continue to recover. Walmart released a statement of condolence, saying, "Our thoughts continue to go out to them, their families and friends, as well as to the families and friends of everyone involved, including Mr. McNair who lost his life."
